Title & Proof of Ownership

Texas titles all vehicles, motorcycles, mopeds, trailers, off-highway vehicles, motorized vessels, non-motorized vessels 14 feet or longer, and internal-combustion outboard motors unless exempt. Manufactured homes receive a Statement of Ownership through the Texas Department of Housing and Community Affairs.

Title-Required, Optional, and Exempt Units

Title Required

Motor vehicles, motorcycles, mopeds, trailers, off-highway vehicles including ATVs, recreational off-highway vehicles, off-highway motorcycles, utility vehicles, sand rails, motorized vessels, non-motorized vessels 14 feet or longer, and internal-combustion outboard motors.

Optional Trailer Title

Trailers and semitrailers with gross vehicle weight of 4,000 lbs. or less, and farm trailers/semitrailers with gross weight of 34,000 lbs. or less, may be titled at the owner’s discretion. Once titled, subsequent titling is required.

Title Exempt / Not Eligible

U.S. government vehicles, snowmobiles, golf carts, implements of husbandry, unconventional machinery, water-well drilling units, commercial vehicles used solely for servicing or drilling oil wells, and USCG-documented vessels are exempt or not eligible for Texas title.

Manufactured Homes

Manufactured homes are issued a Statement of Ownership through the Texas Department of Housing and Community Affairs, Manufactured Housing Division. One Statement of Ownership is issued regardless of the number of sections.

Application for Title

Application for Texas Title and/or Registration (130-U) is submitted to the County Tax Assessor-Collector in the applicant’s county of residence, the county where the vehicle was purchased or encumbered, or any willing county. Proper photo identification is required. Vessels use Vessel/Boat Application (PWD 143); outboard motors use Outboard Motor Application (PWD 144). Manufactured homes use Application for Statement of Ownership (MHD 1023).

Allow approximately seven days for vehicle title processing. TPWD vessel titles are generally mailed after processing. webDEALER calculates applicable fees and taxes for dealer transactions and supports paper and electronic title workflows.

webDEALER

All licensed Texas dealers must use webDEALER to electronically process title and registration applications for retail vehicle sales. County Tax Assessor-Collectors create dealer accounts. webDEALER calculates taxes/fees and facilitates paper and electronic titles. The RTS title record is official proof of ownership for an electronic title.

eTITLE

eTITLE securely transfers titles between dealers using the system. The selling dealer electronically reassigns the electronic title, generates a key code, and the purchasing dealer accepts the electronic title using that code.

Electronic Signatures

Electronic signatures on secure documents are accepted only when submitted through webDEALER, including webSALVAGE. Electronic signatures on non-secure documents are accepted whether submitted electronically or on paper. Electronic signatures on a Certificate of Title Surety Bond and Surety Bond POA are acceptable if they include an embossed or digital seal; other POAs require original signature or certified copy.

Title Only

Title only is permissible when the applicant checks the title-only box. Dealers may apply for title only for retail purchasers in limited cases where the vehicle will not be operated on roads. Title-only transactions show “TONLY##” plate number and “Title Only (No Regis)” registration class.

Proof of Ownership

New Vehicles

Manufacturer’s Certificate of Origin.

Used Vehicles

Certificate of Title.

Non-Title Issuing Jurisdiction

Current registration receipt. If the registration does not contain a transfer of ownership section, a bill of sale is required.

Government Surplus Vehicles

U.S. Government Certificate to Obtain Title to a Vehicle (SF97-1).

Foreign Vehicles

Foreign ownership documents plus Law Enforcement Identification Number Inspection (VTR-68-A), NHTSA HS-7 or other acceptable USDOT compliance document, proof of U.S. entry/clearance, and bond release letter if imported under bond. U.S. military and immediate family returning to Texas are not required to submit VTR-68-A with proof of active-duty status. Foreign documents must be in English or accompanied by certified translation with notarized translator affidavit.

Vessels / Outboard Motors

A signed bill of sale or invoice is required for every vessel or outboard motor transfer and may be included on the application for title, back of TPWD title, handwritten receipt, or sales invoice.

Surrender / NMVTIS: Proof of ownership must be surrendered. Out-of-state titles are imaged and notice is sent to the issuing state. Texas provides data to and inquiries NMVTIS before issuing titles.

Bonded Title, Brands, Duplicate, Odometer & VIN/HIN

Bonded Title

When acceptable ownership evidence is unavailable, submit Bonded Title Application or Tax Collector Hearing Statement of Fact (VTR-130-SOF) with evidence of ownership and $15.00 fee. Bond must equal 1½ times TxDMV value and remain valid three years. VTR-68-A is required if there is no Texas record. Imported vehicles without proper importation documents are not eligible.

Vessel Ownership / Bond

PWD 736 may be used when a vessel/outboard title is unavailable or ownership must be established. Game warden inspection may be required. PWD 388 requests TPWD bonded-title review for vessel/outboard motor when title/legal documentation cannot be obtained.

Title Brands

Brands appear in the Remarks section. Texas carries forward out-of-state brands or Texas equivalents except Bonded Title. Remarks include Actual Mileage, Beneficiary, Bonded Title, Diesel, Flood Damaged, Manufacturer Buyback, odometer brands, Not for Dealer Resale, Off-Highway Use Only, Rebuilt Salvage variants, Reconditioned, Reconstructed, Replica, Survivorship Rights, and VIN Certification Waived.

Certified Copy / Replacement

Application for Certified Copy of Title (VTR-34) is used for vehicle title copies. Proper photo ID is required. If a lien exists, first lienholder may apply. Certified copy cannot issue if active electronic lien exists. Vessels use PWD 143M; outboard motors use PWD 144M.

Odometer Disclosure

Required upon transfer. Model year 2010 or older vehicles, trailers/vehicles without odometers, and trucks over 16,000 lbs. GVWR are exempt. eTITLE and webDEALER support electronic odometer disclosure. Same person may not sign as buyer and seller unless using VTR-271-A.

VIN / HIN Inspection

Vehicle Inspection Report is required on vehicles last registered/titled outside Texas if registering in an emissions county; otherwise VIN certification on title application is required. VTR-68-A may be accepted in certain situations. PWD 504 is required for out-of-state/foreign vessels or motors, incorrect serial numbers, never-titled units, or nonconforming serial numbers. Game warden inspection and assigned HIN may be required.

Stolen, Salvage, Rebuilt, Nonrepairable, Junk & Abandoned Units

Stolen Vehicle / Vessel

Insurer must apply for title in its name when paying a total loss claim on a stolen vehicle. If the vehicle was last titled out of state, attach a statement confirming theft in Texas and total-loss claim payment. Salvage/nonrepairable Texas titles are not issued for unrecovered stolen vehicles. Stolen vessels/outboard motors require law-enforcement incident report or insurer loss/claim report.

Salvage / Nonrepairable Vehicle

Salvage applies when damage or missing major component part repair cost exceeds actual cash value before damage or vehicle is declared total loss. Nonrepairable means residual value is parts or scrap only. Texas Salvage Vehicle Title or Nonrepairable Vehicle Title must be issued before sale/transfer. Use VTR-441. Owner-retained reports are submitted through webSALVAGE before the 31st day after claim payment.

Rebuilt Salvage Vehicle

Rebuilt salvage title is required before transfer after salvage vehicle has been rebuilt. Submit title application with ownership evidence, title fee, $65.00 rebuilt fee, Rebuilt Vehicle Statement (VTR-61), and other applicable fees. Non-titled trailers/semitrailers are exempt from rebuilt fee.

Nonrepairable Restrictions

Nonrepairable vehicles may not be rebuilt, retitled, or operated on public highways. The body/frame cannot be used to repair or assemble another vehicle, and a motor from a nonrepairable flood-damaged vehicle cannot be used to repair or assemble another motor vehicle.

Junk / Demolisher

Registered owner may dispose of a vehicle for demolition, wrecking, or dismantling using VTR-71-2 and $2.00 fee. Vehicles must be destroyed and may not be rebuilt, repaired, reconstructed, made operable, or retitled. Recyclers may use VTR-340, VTR-341-1, VTR-341-2, and VTR-341-3 in specified no-title scrap scenarios.

Abandoned Vehicle / Vessel

Law enforcement auction purchaser receives Auction Sales Receipt (VTR-71-1) as ownership evidence. Excess proceeds are held for owner/lienholder for 90 days. PWD 1344 is used for abandoned vessel/outboard motor bonded-title review when left on private property without consent for more than seven days.

Lien Law

Texas liens are recorded on the TxDMV title record and title is mailed to lienholder or held electronically. A lien is perfected as of the date the application is accepted by a County Tax Assessor-Collector. Texas has an ELT Program, and eTITLE can release electronic titles directly to webDEALER.

Vehicle Lien Filing

To add a lien, submit Application for Texas Title and/or Registration (130-U) with vehicle title and title fee. Additional liens use Additional Liens Statement (VTR-267) with title and title fee. If title is lost/destroyed, the certification section of the title application may be completed instead of obtaining duplicate.

Vessel / Outboard Motor Lien

Request to Release a Lien, Add a New Lien, or Correct a Lien (PWD 403) is used for vessels and outboard motors.

Lien Expiration

TxDMV may cancel a discharged lien recorded for 10 years or more if the recorded lienholder does not exist or cannot be located, after research and owner statement that the lien has been satisfied, is 10 or more years old, and lienholder is out of business/cannot be located.

Responsible Party

Texas licensed motor vehicle dealers are responsible for filing title transfers and recording liens. Out-of-state dealers may file the lien; otherwise lienholder or owner is responsible. Lienholder or owner files liens on private-party sales.

Assignment, Foreclosure, Release, UCC & ELT

Assignment of Lien

Lienholder may assign a lien without notice, and the lien remains perfected with priority. New lienholder may file 130-U marked Lien Transfer/No Change in Ownership with copy of assignment agreement, title, and fee.

Foreclosure Liens

Foreclosure lien requirements vary. Forms include VTR-265-M, VTR-265-VSF, VTR-265-FM, VTR-265-S, VTR-265-SSF, and VTR-265-L. Vessel/outboard foreclosure may use PWD 309A, PWD 309B, or PWD 309C with required notice, contract, and publication if ownership cannot be determined.

Release of Lien

Vehicle lienholder has 10 days after final payment to release the lien. Release may be on title, Prescribed Form for Release of Lien (VTR-266), or company letterhead. Vessel lien releases use PWD 231 or PWD 403 and lienholder signature must be notarized. ELT liens must be released electronically; paper lien releases are not accepted for ELTs.

UCC

Liens on non-titled vehicles are filed with the Texas Secretary of State, Uniform Commercial Code Section, PO Box 13193, Austin, TX 78711-3193, or 1019 Brazos Street, Austin, TX 78701. Email: ucc_assist@sos.texas.gov. Online filing is available.

Title with Lien

Title is mailed to lienholder or held electronically. For electronic titles, an electronic title record is issued to lienholder and a title application receipt is issued to owner and lienholder.

ELT Program

Lienholders interested in ELT must complete the Electronic Lien and Title Intake Form, meet technical specifications, complete certification testing, sign a Service Level Agreement, and email documents to VTR_eTitles@txdmv.gov. Multiple-lienholder titles must be paper.

Transfer of Title

Texas transfer is completed by assignment of title. Title application must generally be submitted within 30 days to avoid penalty; military personnel have 60 days, seller-financed dealer sales may allow 45 days, manufactured homes sold for residential use have 60 days, and vessels have 45 business days.

Transfer Notifications and Timing

Texas licensed dealers must submit a Vehicle Transfer Notification for vehicles with an existing Texas record. Private sellers may submit Motor Vehicle Transfer Notification (VTR-346) within 30 days to avoid liability. Vessel owners must notify TPWD within 15 days using PWD 1340 or online. New residents must apply for Texas title and registration within 30 days of residency; vessels within 90 days.

Add / Remove Owner

All parties must complete the assignment of title. License plates and registration may be transferred.

Damage / Lemon Disclosure

Texas Lemon Law Reacquired Vehicle Disclosure Statement must be provided by the selling dealer for a vehicle reacquired to resolve a lemon law complaint or warranty claim. Selling or transferring a salvage vehicle without a Salvage or Nonrepairable Title is a Class C misdemeanor, with increased penalties for prior convictions.

Joint Ownership / Survivorship

If more than one person is recorded as vehicle owner, each signature is required to transfer or encumber the vehicle. Rights of survivorship may be recorded using VTR-122 for motor vehicles or PWD 790 for vessels.

Deceased Owner

If joint owner with rights of survivorship dies, submit death certificate with title application. If probated, personal representative may assign title with certified probate or appointment letters. If no will or no administration, submit court document showing no administration and notarized Affidavit of Heirship for a Motor Vehicle (VTR-262) signed by all heirs. Vessels may use PWD 738.

Transfer on Death

Vehicle owners may designate a beneficiary using Beneficiary Designation for a Motor Vehicle (VTR-121). Applicant type must be Individual. If multiple owners, rights of survivorship must be recorded and all owners must consent. Beneficiary must apply for title within 180 days after last surviving owner’s death.

Notarization

Texas title notarization is not required.

Power of Attorney

VTR-271-A may be used by licensed dealers, salvage yards, and insurers for vehicles subject to odometer disclosure when title is lost, paper/electronic lienholder-held, or electronic title record cannot be accessed. VTR-271 may be used for eligible non-odometer transactions; vessels use PWD 1055 or PWD 581 authorization.

Limited Assignment Space

Texas dealers may attach Dealer’s Reassignment of Title for a Motor Vehicle (VTR-41-A). eTITLE electronic reassignment replaces required paper reassignment. Individuals must title in their name before transfer.

Repossession

Upon default, a secured party may take possession without judicial process if it proceeds without breach of peace. Texas repossession transfers require lienholder documentation and title application, but reference lien tables do not list a separate repo-title requirement.

Motor Vehicle Repossession

Lienholder submits notarized Repossessed Motor Vehicle Affidavit (VTR-264), title application, Texas title, and title fee. If lien is not recorded on title, attach copy of security agreement and lienholder must apply for title in its name before transferring to a new purchaser. Second-lienholder repossession requires release from first lienholder.

Vessel / Outboard Motor Repossession

Use Certification for Repossessed Vessel and/or Outboard Motor (PWD 312), title application, Texas title, and title fee.

Tax

A lienholder taking title to a repossessed vehicle or vessel is exempt from paying sales tax.

Out-of-State Repossession

A vehicle registered or titled in another state may be repossessed in Texas if the out-of-state title is in or assigned to the person from whom repossession was made. If ownership document is unavailable, lienholder must repossess out of state and obtain title from that state before transfer in Texas.

Registration

Texas requires registration for vehicles operated on highways or public roads and for motorized vessels, non-motorized vessels 14 feet or longer, and USCG-documented vessels used on Texas public waters, including when docked, moored, or stored, unless exempt. Off-highway vehicles are generally not eligible for regular registration but may require TPWD OHV decals and may be eligible for limited-use plates.

Application for Registration

130-U is submitted to the County Tax Assessor-Collector in the county of residence, county where purchased/encumbered, or any willing county. Registration must be applied for within 30 days of purchase or establishing residency if the vehicle is operated on Texas roads. Vessels are registered through TPWD. Commercial vehicles over 10,000 lbs. must carry registration receipt showing empty weight, carrying capacity, and gross weight.

  • Farm trailers/semitrailers with gross weight of 4,000 lbs. or less are exempt from registration.
  • Commercial tugboats, vessels exceeding 115 feet, and pilot/crew boats transporting freight/supplies/personnel to/from cargo ships, freighters, or offshore oil infrastructure are exempt.
  • Golf carts and OHVs may be eligible for limited-use golf cart or OHV plates when authorized by a municipality or county.
  • Non-operational or stored vehicles are not required to be registered, but unregistered vehicles may not be parked on public streets. Vessels must have current registration when docked, moored, or stored.

IRP

TxDMV Motor Carrier Division handles IRP. Phone: 800.299.1700. Email: TxFleet@TxDMV.gov. New accounts must be set up online in TxFLEET, which manages Texas-based fleets.

Nonresidents

Nonresident private passenger vehicles properly registered in the home state may be used in Texas with reciprocity if not operated for compensation. Nonresident farm-product transport may need a Nonresident Agricultural Products Receipt. Foreign commercial motor vehicles may be exempt when operating solely across the border into/from a border commercial zone.

OHV Nonresidents

Nonresident OHVs must have a TPWD OHV decal if used on public lands or private OHV venues receiving TPWD OHV grant funds.

Vessel Nonresidents

Vessels with current out-of-state registration may be operated in Texas up to 90 consecutive days without Texas registration. Use tax is due upon arrival unless a temporary use tax permit is obtained, and vessel/motor must leave Texas before the permit expires or use tax becomes due.

Renewal

Vehicle renewal reminders are sent. Renewal may be in person, by mail, or online through county of residence or any willing county. Online renewal receives a $1.00 discount from processing/handling fee. Vessels may renew online, in person at TPWD or participating county tax offices, or by mail.

Inspection / Insurance

Proof of insurance is required for initial registration and renewal. Commercial motor vehicles and assembled vehicles must pass safety inspection prior to registration/titling. Noncommercial vehicles are generally exempt from safety inspection, but inspection program replacement fees may apply at registration.

Special Permits, Plates & Dealer Use

Temporary Permits

Texas uses temporary permits for specific short-term vehicle movements, dealer sales, out-of-state transport, and commercial operations. Verify current permit type, duration, and fee with TxDMV or the County Tax Assessor-Collector before issuing or quoting.

OHV Decal / Limited Plates

OHVs used on public lands or eligible private venues require TPWD OHV decal. Golf cart and OHV plates may allow limited operation where authorized by local ordinance or county rules.

Dealer Plates

Dealer plates and temporary tags are handled through TxDMV dealer systems and webDEALER. Dealer files should document sale date, buyer information, temporary tag issuance, title submission, lien filing, and tax collection.

Manufacturer / Transporter

Manufacturer, transporter, and commercial permits may be available for qualifying movement and dealer/manufacturer business purposes. Verify current TxDMV permit rules by use case.

Plates

Texas plate handling varies by vehicle type, registration class, and transfer scenario. Verify whether plates transfer, remain with vehicle, or must be removed/surrendered for the specific transaction.

Military

Active-duty military personnel have extended transfer-tax timing in some cases. U.S. military and immediate family returning to Texas are not required to submit VTR-68-A for foreign vehicles with proof of active-duty status.

Dealer Fee Reminder

Dealer estimates should account for title fee by county, registration class and local/county fees, sales/use tax, SPV rules where applicable, TERP surcharge, inspection program replacement fee, lien filing, temporary tag/permit fees, webDEALER processing, and TPWD or manufactured-housing fees where applicable.

Motor Vehicle Sales / Use Tax

Texas motor vehicle sales/use tax is generally 6.25% of taxable purchase price, subject to applicable Standard Presumptive Value procedures for private-party transactions. A $10.00 gift tax applies to a motor vehicle received as a gift from an eligible donor to an eligible recipient using Affidavit of Motor Vehicle Gift Transfer (14-317). Tax is generally due within 30 days of purchase or first use in Texas; 60 days for active-duty military personnel; and at time of transfer for even exchange or gift tax.

Out-of-State Use Exemption

Vehicles purchased in Texas for use exclusively outside Texas may be exempt with Motor Vehicle Sales Tax Exemption Certificate – For Motor Vehicles Taken Out of State (14-312). IRP vehicles, OHVs, qualified farm and timber machines or trailers/semitrailers, manufactured homes, mobile offices, oilfield portable units, towable/moveable specialized equipment, and qualified hydrogen-powered motor vehicles may be exempt.

Limited Sales / Use Tax

Texas limited sales/use tax is 6.25% on taxable tangible personal property, with local sales/use tax up to 2.0%. Remote sellers may elect an alternate single local use tax rate. Credit may be allowed for legally imposed sales/use tax paid to another state.

Boat / Outboard Motor Tax

Boat and boat motor sales/use tax is 6.25% of retail sales price or use in Texas unless exempt. Credit is allowed for same-transaction trade-in. Texas boat/boat motor sales tax may not exceed $18,750 for each boat and boat motor sold in Texas, but there is no cap on use tax. New residents may qualify for $15.00 new resident tax per taxable boat/motor previously registered in their name elsewhere.

Boat Tax Exemptions

Boat/outboard motor may be exempt if removed from Texas within 10 days of purchase, placed in permitted repair facility within 10 days and removed within 20 days after repairs, or removed within 90 days when a temporary use permit is purchased. Use tax is due within 45 business days from delivery or date brought into Texas.

Manufactured Housing Tax

Manufactured housing sales/use tax is 3.25% on the first sale of a new manufactured home for use in Texas unless exempt. Generally collected by seller with a Texas Manufactured Housing Sales and Use Tax Permit; otherwise purchaser may remit using Manufactured Housing Use Tax Payment (18-101).

TERP Surcharge

TERP surcharge is 1.0% on 1997 or later diesel-powered motor vehicles over 14,000 lbs. registered weight and 2.5% for 1996 or earlier. A 1.5% TERP surcharge applies to qualifying off-road heavy-duty diesel equipment 50 hp or greater unless exempt.

Rental / Lease Tax

Motor vehicle rentals of 30 days or less are taxed at 10.0% of gross rental receipts; 31–180 days at 6.25%. Certain local venue taxes may apply. For leases, lessor pays 6.25% motor vehicle sales tax when vehicle is purchased and titled/registered in Texas; lease payments are not separately taxed as motor vehicle sales tax.

Property / Dealer Tax Files

Dealer files should retain sales invoice, trade-in documentation, exemption certificate, SPV documentation where applicable, TERP calculations, gift/even-exchange affidavits, and proof of tax paid to another jurisdiction when credit is claimed.

General Information

Dealer Workflow

Dealer packets should include 130-U, assigned title/MCO or eTITLE reassignment, webDEALER transaction, lienholder/ELT information, odometer disclosure, tax calculation, proof of insurance when required, inspection status, temporary tag documentation, and applicable salvage/rebuilt or brand disclosures.

webDEALER / eTITLE Workflow

Licensed dealers must use webDEALER for retail title/registration applications. eTITLE supports dealer-to-dealer electronic reassignment with a key code and immediate availability after acceptance.

TPWD Workflow

Vessels and outboard motors are titled/registered through TPWD using PWD 143, PWD 144, and related TPWD forms. Vessel transfers require signed bill of sale/invoice, and owner transfer notification should be filed within 15 days.

Manufactured Housing Workflow

Manufactured homes receive a Statement of Ownership through TDHCA Manufactured Housing Division using MHD 1023. Tax and Texas Seal requirements may apply.

Records

Vehicle title and lien records are maintained in the official TxDMV record. Texas participates in NMVTIS. TPWD maintains vessel/outboard motor records.

Insurance / Inspection

Motorist liability insurance is required on all motor vehicles and proof must be carried physically or electronically. Minimum private-passenger liability limits are $30,000/$60,000/$25,000, with higher limits for certain carriers. Proof of insurance is required at initial registration and renewal.
